On 11 March 2020, the Court of Justice of the European Union issued its judgment in Case C‑454/18 Baltic Cable v the Swedish regulator, interpreting Article 16(6) of Electricity Regulation 714/2009 as it applies to single interconnector companies such as Baltic Cable. The Court held that a rigid, one‑size‑fits‑all application of the congestion revenue rules that forced Baltic Cable to retain all income in an escrow account, preventing it from earning a reasonable return and risking bankruptcy, would discriminate against such standalone interconnector owners and jeopardise EU interconnection objectives.
