Licence: Judgment in Case C‑454/18 on application of Electricity Regulation 714/2009 Article 16(6) to Baltic Cable congestion revenues
On 11 March 2020, the Court of Justice of the European Union issued its judgment in Case C‑454/18 Baltic Cable v the Swedish regulator, interpreting Article 16(6) of Electricity Regulation 714/2009 as it applies to single interconnector companies such as Baltic Cable. The Court held that a rigid, one‑size‑fits‑all application of the congestion revenue rules that forced Baltic Cable to retain all income in an escrow account, preventing it from earning a reasonable return and risking bankruptcy, would discriminate against such standalone interconnector owners and jeopardise EU interconnection objectives.
Baltic Cable HVDC link achieved first power in December 1994, connecting the German and Swedish grids via 600 MW monopole transmission at 450 kV.
The Baltic Cable HVDC subsea interconnector between Lübeck‑Herrenwyk in Germany and Kruseberg in Sweden entered operational service in 1994, providing 600 MW of transmission capacity at 450 kV over a 262 km route across the Baltic Sea.
The Baltic Cable HVDC interconnector, including the Herrenwyk converter station near Germany’s Baltic coast and the Kruseberg converter station in southern Sweden supplied by Hitachi Energy, was commissioned in 1994. The 600 MW, 450 kV DC link, owned by Baltic Cable AB, began operation to interconnect the Swedish and German grids and enable more efficient use of existing generation capacity.
ABB selected as turnkey contractor for the Baltic Cable HVDC submarine cable system. Project team formed in 1991 and organised into three subprojects: Cable, Converter and Overhead line. Cable manufactured at ABB Karlskrona factory in Sweden.
ABB selected to deliver both HVDC converter stations (Herrenwyk, Germany and Kruseberg, Sweden) for the Baltic Cable project. LCC thyristor valve technology. Part of ABB turnkey contract covering cable and converters.
