On 24 April 2024 the Dutch Minister for Climate and Energy, R.A.A. Jetten, published in the Staatscourant (Stcrt-2024-14333) the Voorbereidingsbesluit windenergiegebied Nederwiek (noord) (beoogde kavels II en III), in agreement with the Minister of Binnenlandse Zaken en Koninkrijksrelaties. The instrument declares that kavelbesluiten will be prepared for intended sites II and III in the northern Nederwiek wind energy area, located in the Dutch exclusive economic zone approximately 95–120 km north-west of windenergiegebied IJmuiden Ver and covering roughly 650 km² gross. With the voorbereidingsbesluit in force from the day after publication (25 April 2024), any new works, modifications to existing works, or placement of substances/objects within the location and a 500-metre safety zone require an exemption, except for maintenance of existing permitted activities and preparatory work for the kavelbesluit itself. The decision functions as a spatial freeze, preventing third-party developments that could obstruct or render impossible the future construction of the Nederwiek II and III wind farms ahead of the formal kavelbesluit and tender process. No objection or appeal is available against the voorbereidingsbesluit under art. 8:5 jo. 7:1 Awb.
